STATEMENT:

The above listed Review Appraiser posted on his WEB sites MKG Appraisal and Skippy List  information of two review appraisals.

Information he states were not presented:

were all listed on the Multi-Purpose Addendum and Supplemental Addendum. I can only assume he either did not read the entire report or it was not given to him. The contract for 476 Kenton Street was faxed to me after I started the report.  I report the above information on the noted forms, but forgot to back and put the sale price on the front of the URAR.

I requested a copy of the contract for 1657 S. Sedalia Street but did not receive one. However, at the lender's request I had previously faxed comp information from the Metrolist Book .... Page number and item.  I keep this information in a folder, so if I'm asked to do an appraisal on the property some of the research is all ready done.

There is no such thing as a predetermined value.  It isn't necessary.  I have all ready given the comparable sales that I think are most similar to the subject property.

I was not aware of the concessions of the sales comparables. This information was not printed in the MetroList Sold Books that I used. The Realtors were not forthcoming about points or concessions when I called therefore, none was reported in the appraisal report. This is not a case of failure to do due diligence. The information was not available to me.

In approximately December 2004, Mr. Clarence Williams of Rural Development told me I needed to call Metrolist to find out how to get the information that was not listed in the book.  I called and the man in customer service actually walked me through the steps telling me how to go on line.... that gives me more complete information.  In addition, after my conference with the FHA Officials, I received a card "Colorado Comps" that helps me further with complete information. This is a feat in itself because I don't have to depend on the word of busy Realtors.

However, Mr. Rice has decided what the circumstances were, calling me unethical with the intent to defraud.

He is not clairvoyant and, I can assure you, has no basis for his conclusions. Nor does he Have the right to slander my name or malign my reputation.

I have not worked since the end of November and I need to work. Without restraint he spewed his opinions He did not bother to ask me for any details .... all to my loss. What he has done is unconscionable. The "Guidance for Completing the Appraisal Review Report" states:

2. " The review appraiser must focus his or her comments on the appraisal report under review and not include personal opinions about the appraiser who prepared the appraisal".

The ETHICS RULE sets forth the requirements for integrity, impartiality, objectivity, independent judgment, and ethical conduct. Mr. Rice ignored all the above.

USPAP states; An appraiser must not disclose confidential information or assignment results prepared for a client to anyone other than the client and persons specifically authorized by the client; state enforcement agencies and such third parties as may be authorized by due process of law; and a duly authorized professional peer review committee except when such disclosure to a committee would violate applicable law or regulation.  It is unethical for a member of a duly authorized professional peer review committee to disclose confidential information presented to the committee.

Mr. Rice violated the Ethics Rule choosing to make the results of his reviews available to the whole world.
