Dear Mr. Rice,
I do not mean to have an adversarial relationship to you. I also
appreciate some of your statements (like the one where you find it hard
to reply when people spell your name incorrectly). I am presuming that
you have nothing against me personally, and so I am asking that you
allow me to make a formal reply to your allegations, and that you will
please post to your website, not in a link that needs to be opened, but
in the same format on the same page as your allegations.
Please note: the website to order an appraisal from my appraisal firm

is NOT the place to order an appraisal for my company. It is a site that
no one has ever used, but should it be in the future, a site where, “The
Sky is the Limit” on the services that this company would offer, should
it ever start up, to professionals in the real estate industry. “The Sky
is the Limit” on the quality of service and friendly professionalism you
receive from either company.
The confidential case that was filed did not have severe penalty and
was satisfied in September of 2006. The penalty was to take further
educational courses, which have been taken, submitted to the State, and
accepted by the State. The case is closed. There was not, and will not
ever be a trial regarding this case. HUD reviewed the file and no action
was taken. I am in good standing, and always have been, and always
intend on being, with both HUD and BOREA. HUD has since refinanced the
loan with another appraiser and is presumably satisfied with the value
and the loan, as the appraisal done six month after mine appraised even
higher than mine did.
You no longer have to continue to waste your efforts on this file. It
was satisfied months ago. The reason you are not receiving that
information is because this file is confidential, and I am taking the
liberty of providing you with the results so that you do not have to
continue to waste your time and energy. I appreciate a public posting,
not only so that people can see my reply to your statements on page
http://www.mkgappraisal.com/McDonald_summary.htm, on that same page, and
not in a link, but in the same format as your statements.
For the record. You have never contacted me directly, either by mail,
telephone, fax or email, and you have never responded to any of my email
or fax requests. Mr. Rice and I have never directly had any contact with
each other, other than my emails and faxes sent to Mr. Rice.
I appreciate what your are trying to do, Mr. Rice. I feel that you
are wasting your efforts by continuing your search to find the results
of my complaint, or to insinuate, incorrectly, that “The Sky is the
Limit” on my appraised values. Its over and done, has been for several
months, and I hope this letter can lay that all to rest.

I filed a complaint
with the Colorado BOREA and HUD on the same day – 08/02/04. Both
complaints were submitted with photos.
Complaint filed against appraiser Stacy McDonald,
Colorado license number AL40022342. Subject Property:
411 Harlan St,
Lakewood, CO 80226
It's not clear if HUD even bothered to investigate. I have good reason to
think HUD declined to act because the loan did not go into foreclosure.
This is (more or less) the definition of a good appraisal at HUD.
If HUD did investigate, they took no action. Stacy McDonald is in
good
standing at HUD. To put this in perspective, the same borrower
came back 6 months later and asked for $5,000 more and
HUD made the loan.
I received a form letter from Future
Davis dated 9/21/04. This letter shows the name of the
appraiser as Robert Stacy McDonald - which is incorrect. I sent a
letter dated 11/14/04 to Future
Davis to straighten out the mistake, and to ask for the case number, and
to clarify that my complaint was not a review. I got an informal
response from Future that the case number was a secret.
I broke the case number secret code by attending the BOREA March 11,
2005 meeting. The BOREA Case number assigned to the McDonald
complaint is 805 5050 (Future Davis). At the meeting, the Board
considered 2 possible actions and voted for the more severe of the 2 -
but as I recall, this was a motion to go behind closed doors and then
decide what to do. As a member of the peanut gallery, I went away
from the meeting with nothing specific.
Effective mid February 2006, the McDonald complaint
has not been resolved, and no case number assigned at the Office of
Administrative Courts within the Colorado Department of Personnel &
Administration. It is my opinion/prediction that if this case does
"go to court" it will be at least next year (2007) before it gets
resolved.
If the case is headed for a plea bargain type settlement - it's hard to imagine
how it can take the Board 12 months to get the case resolved.
In the mean time, Stacy McDonald is "innocent until proven guilty" and therefore fully licensed
and able to conduct business as usual.
